1. Authorship and ownership

1.1. The Book of Temperaments and the other texts, diagrams, illustrations, examples, and materials published on this site are works authored by Igor Rafael Oliveira Carneiro (Igor R. O. Carneiro), who is also the owner of the economic rights, unless other authorship or ownership is indicated in the material itself.

1.2. Axis Ratio is the theoretical system formulated by the author and set out in these works.

1.3. Images, quotations, and other third-party elements that may be reproduced remain with their respective owners and are identified where they appear.

2. Registration

2.1. An earlier version of The Book of Temperaments has a copyright registration with the Câmara Brasileira do Livro (CBL).

2.2. The current version of the work, published on this site, has been deposited for registration with the Copyright Office (Escritório de Direitos Autorais) of the Fundação Biblioteca Nacional.

2.3. Registration documents the content of the deposited version, the date of deposit, and the declared authorship. It does not create the copyright, which arises with the creation of the work (Law No. 9.610/98, art. 18), and it does not certify originality, novelty, or scientific validity.

2.4. Texts added or changed after these deposits are equally protected, regardless of registration.

3. What is protected

3.1. The following are protected by Law No. 9.610/98, to the extent of their original expression:

• a) the texts of the book and of the other pages;
• b) the diagrams, tables, illustrations, and other visual elements created by the author;
• c) the definitions developed, the distinctions, the chains of argument, and the examples, as expressed in the work;
• d) the selection, organization, and arrangement of the content, where they constitute an intellectual creation (art. 7, XIII).

3.2. The title The Book of Temperaments is protected under art. 10 of Law No. 9.610/98.

4. What is not subject to exclusivity

4.1. The law does not protect as copyright ideas, systems, and methods considered in themselves (Law No. 9.610/98, art. 8, I), nor isolated names and titles (art. 8, VI).

4.2. The tradition of the four temperaments is common ground. Anyone may study the subject, criticize or dispute the author’s conclusions, and formulate a truly independent theory.

4.3. What these Terms protect is the concrete work in which Axis Ratio was formulated. Changing words does not make substantial reproduction of that work lawful, and crediting the author does not replace permission when permission is required.

4.4. The name AXIS RATIO is the subject of a trademark application with the Instituto Nacional da Propriedade Industrial (INPI), in class 41.

5. Uses permitted without requesting permission

Without requesting permission, you may:

• a) read and consult the content for personal use;
• b) quote passages of the work in studies, academic papers, reviews, or debates, to the extent justified by the purpose, crediting the author’s name and the source (Law No. 9.610/98, art. 46, III);
• c) share the link to the pages;
• d) make the other uses the law allows without permission (Law No. 9.610/98, arts. 46 to 48).

6. Uses that require prior and express permission

The following, among others, require the author’s prior and express permission:

• a) reproduction of the work, in whole or in part, including diagrams and tables, beyond the limits of quotation (art. 29, I);
• b) adaptation or any other transformation of the work, including rewriting that substantially and recognizably keeps the same distinctions, the same chain of argument, and the same examples (art. 29, III);
• c) inclusion of the work or parts of it in courses, handouts, presentations, videos, publications, or commercial materials;
• d) distribution of the work or making it available to the public by any means (art. 29);
• e) use of the name Axis Ratio to identify third-party products or services, or the suggestion of an affiliation, partnership, or certification that does not exist.

7. Temperament Test

7.1. The test result is provided for personal and informational use. It does not constitute a psychological or medical diagnosis.

7.2. These Terms do not permit extracting, bulk copying, or reproducing the questions, the model results, or the flow of the test in order to offer them to third parties.

8. How to cite

Reference for the work (ABNT):

9. Permission and license requests

9.1. Uses beyond item 5 may be requested by email at contato@olivrodostemperamentos.com, with a description of the intended material, purpose, medium, audience, and duration.

9.2. Permissions are granted in writing, case by case, and interpreted restrictively (Law No. 9.610/98, arts. 4 and 49, VI). Paying for access to any content or service on this site does not authorize teaching, reproducing, adapting, or sublicensing the material.

10. Unauthorized use

10.1. Unauthorized use may subject the person responsible to the measures provided for in arts. 102 to 110 of Law No. 9.610/98, such as suspension of dissemination and compensation for material and moral damages, and, where the law provides, to the penalties of art. 184 of the Penal Code.

11.1. These Terms are governed by Brazilian law.
